Terms of Service

Plain-language terms for using the Murmur app.

1. Agreement

By downloading or using Murmur ("the App"), you agree to these Terms of Service. If you are using the App on behalf of a minor, you represent that you are the parent or legal guardian and you accept these terms on their behalf.

2. What Murmur Is

Murmur is an ambient sound application that plays pre-recorded audio tracks for sleep, focus, and relaxation. It is a utility application. It does not generate user content, facilitate social interaction, or connect to external services.

3. Permitted Use

You may use Murmur for personal, non-commercial purposes. You may not:

  • Reverse-engineer, decompile, or extract audio assets from the application
  • Redistribute audio content bundled with the application
  • Use the application in a manner that violates applicable law

4. Intellectual Property

The Murmur application, including its design, code, and branding, is owned by Jordan Thirkle. Audio tracks within the application are licensed under Creative Commons Zero (CC0) or equivalent royalty-free licences. See in-app credits for attribution where applicable.

5. Disclaimer of Warranties

Murmur is provided "as is" without warranties of any kind. We do not warrant that the application will be uninterrupted, error-free, or suitable for any particular medical or therapeutic purpose. The app is a utility, not a medical device.

If your child has a medical condition or sleep disorder, consult a qualified healthcare professional. Murmur is not a substitute for professional medical advice.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Jordan Thirkle shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the application.

7. Changes to the App and Terms

We reserve the right to modify or discontinue the App at any time. We may update these Terms; continued use of the App after changes constitutes acceptance of the updated Terms.

8. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
